Dr. Audu was arraigned on Wednesday, April 1, 2026, before Justice Binta Dogonyaro on a three-count charge filed by the Commission.
According to the ICPC, the defendant allegedly abused his office between 1990 and 2024 to confer undue advantage on himself and falsified his date of birth to unlawfully extend his tenure in public service.
At the commencement of proceedings, defence counsel, L.O. Ali, raised preliminary objections, arguing that a similar matter was already pending before another court and describing the charge as filed in bad faith.
However, prosecution counsel, Glory Iroegbu, opposed the application, citing provisions of the Administration of Criminal Justice Act which require that arraignment be concluded before hearing preliminary objections.
In her ruling, Justice Dogonyaro upheld the prosecution’s argument and directed that the defendant take his plea.
One of the charges alleges that Audu, while serving as Acting Comptroller General, used his position to procure the sale of an official Toyota Prado Land Cruiser SUV to himself for ₦4 million without due process, contrary to the Corrupt Practices Act.
The Commission further alleged that he made a false declaration of age in 1990, stating his date of birth as December 3, 1964, instead of July 25, 1960, and continued to receive salaries and benefits between 2020 and 2024 beyond his lawful retirement period.
The defendant pleaded not guilty to all charges.
Following his plea, the court granted him bail in the sum of ₦5 million per count with two sureties in like sum. The sureties are required to be property owners within the FCT, with at least one being a federal civil servant not below Grade Level 10. He was also ordered to deposit his international passport with the court.
The case was adjourned to May 14, 2026, for commencement of hearing.
