Taliban Enacts Controversial Penal Code Allowing Domestic Punishment
The ruling authorities in Afghanistan have introduced a new penal code that permits husbands to physically punish their wives and children, provided the punishment does not result in broken bones or open wounds.

The law, signed by Taliban leader Hibatullah Akhundzada, also establishes a tiered justice system that applies different penalties based on social class. Society is categorized into religious scholars, the elite, middle class, and lower class, with punishments varying accordingly.
Under the code, religious scholars are reportedly subject only to advisory measures, while offenders from lower social classes may face imprisonment or corporal punishment. In cases involving domestic violence, husbands may receive up to 15 days in detention if visible injuries are proven. Women alleging abuse are required to present their case in court fully covered and accompanied by a male guardian.
The legislation further stipulates that women who visit relatives without their husband’s permission could face up to three months in jail.
The measures have drawn strong criticism from rights advocates. Afghan human rights organization Rawadari has called on the United Nations to intervene, warning that the code institutionalizes discrimination and abuse.
Reem Alsalem, the United Nations Special Rapporteur on violence against women and girls, described the provisions as alarming and deeply concerning for the safety and dignity of women and girls in Afghanistan.
The development marks another tightening of restrictions under Taliban rule, intensifying international scrutiny over human rights conditions in the country.
