Court Reschedules Judgment in EFCC’s N212bn Asset Forfeiture Suit Against Ex-AGF Malami
A Federal High Court in Abuja has rescheduled judgment in the suit filed by the Economic and Financial Crimes Commission (EFCC) seeking the final forfeiture of 57 properties allegedly linked to former Attorney-General of the Federation and Minister of Justice, Abubakar Malami.
Justice Joyce Abdulmalik, who had earlier fixed Monday, July 6, 2026, for judgment after parties adopted their final written addresses on May 26, adjourned the matter to Friday, July 10, 2026.
The EFCC is seeking the permanent forfeiture of the properties, valued at over N212 billion, following an earlier interim forfeiture order granted by the court. The assets are located across Abuja, Kano, Kebbi and Kaduna States.
The anti-graft agency contends that the properties are proceeds of alleged official corruption and abuse of office.
At the last hearing, counsel to the EFCC, Jibrin Okutepa (SAN), urged the court to grant the Commission’s application, relying on a 47-paragraph affidavit and 46 documentary exhibits tendered in support of the motion.
Okutepa argued that Malami and the other respondents failed to provide satisfactory explanations regarding the legitimate sources of the assets and prayed the court to order their final forfeiture to the Federal Government.
However, counsel to Malami and the other respondents, Adedayo Adedeji (SAN), urged the court to dismiss the application and set aside the interim forfeiture order.
Adedeji maintained that the properties were lawfully acquired by the former minister during and after his service under the administration of former President Muhammadu Buhari, arguing that the EFCC’s case was based on suspicion rather than credible evidence.
Following the arguments of both parties, Justice Abdulmalik adjourned the matter until July 10, 2026, for judgment.
