German Lawmaker Jens Spahn Resigns Leadership Role After Surrogacy Controversy

Senior German lawmaker Jens Spahn, a prominent member of Chancellor Friedrich Merz’s centre-right Christian Democratic Union (CDU) party, has resigned from his leadership position in parliament following public controversy over his decision to use a surrogate mother in the United States to start a family.

Party sources confirmed on Saturday that Spahn stepped down as chairman of the CDU parliamentary group after acknowledging that his personal circumstances had created a conflict with his political responsibilities.

In a letter to his colleagues, Spahn said he had come to the conclusion that becoming a father with his husband through international surrogacy was incompatible with continuing in his current political role.

“In recent days, I have come to realise that my personal happiness in starting a family with my husband and becoming a father is incompatible with my political office,” Spahn wrote in the letter obtained by AFP.

The controversy arose because surrogacy is prohibited under German law, although some German citizens have pursued the process abroad in countries where the practice is legally permitted.

Spahn, who has served as one of the most influential figures in the CDU and previously held the position of Germany’s Federal Minister of Health from 2018 to 2021, has faced criticism and debate over the legal and ethical questions surrounding international surrogacy.

His resignation highlights the continuing discussion in Germany over reproductive rights, family law, and whether existing regulations should be reconsidered in light of changing social realities.

Spahn remains a member of the Bundestag, Germany’s federal parliament, but his departure from the CDU parliamentary leadership marks a significant political development for Chancellor Merz’s governing bloc.
